In case you missed it, Jeffrey attended the first day of trial for the latest Monsanto case, Hardeman V. Monsanto. This case leads the more than 11,000 lawsuits pending against Monsanto in U.S. District Court in San Francisco. Weeks ago, presiding judge Vince Chhabria approved a motion by Monsanto to bifurcate the trial and thus limited evidence jurors will hear during the first phase to causation only. This was a huge procedural victory for Monsanto. It excludes any evidence of Monsanto’s conduct behind the scenes (rigging the science, ghostwriting, undue influence, burying science) that sheds a negative light on the studies Monsanto presents to fight causation. The challenges the plaintiff’s attorneys face became evident on opening day, what Jeffrey compared to “wrestling with one hand tied behind your back.”
